Terms of Service

These Terms of Service ("Terms") govern your use of the Marlo Private Transport Florida website and your request, booking, and use of private transportation services.

By submitting a quote request, accepting a quote, making a payment, confirming a reservation, or using our services, you agree to these Terms. If you do not agree, do not use our website or services.

1. Description of Services

Marlo Private Transport Florida provides pre-arranged private ground transportation services in Central Florida and surrounding areas. Services may include airport transfers, theme park transportation, hotel and resort transportation, cruise transfers, Kennedy Space Center transportation, family transportation, group transportation, and other scheduled private trips.

All trips must be requested and confirmed in advance. We do not accept street hails, and we are not a ride-hailing marketplace. Service availability depends on vehicle availability, driver availability, scheduling, location, trip details, payment status, and applicable legal or operational requirements.

2. Quote Requests

A quote request is not a confirmed reservation.

When you submit a quote request through our website, WhatsApp, SMS, email, phone, or another communication method, we will review the trip details and may provide a price quote. A reservation is confirmed only after we send written confirmation by email, SMS, WhatsApp, or another written communication method.

We may decline any quote request or booking request at our discretion, including when the trip is outside our service area, a vehicle is unavailable, information is incomplete, payment is not completed, or the request creates safety, legal, or operational concerns.

3. Client Information and Accuracy

You are responsible for providing complete and accurate trip information, including:

  • Full pickup address and full drop-off address
  • Date and pickup time
  • Flight number, airline, cruise details, or event details, if applicable
  • Number of passengers, amount and size of luggage
  • Child-seat needs, mobility or accessibility needs
  • Additional stops, special instructions, and preferred contact method

We are not responsible for delays, missed pickups, missed flights, missed cruise departures, additional charges, or service issues caused by incorrect, incomplete, late, or outdated information provided by you. You must notify us as soon as possible if your trip details change.

4. Pricing

Prices are based on the trip details available at the time of quote. Pricing may consider pickup location, drop-off location, date, time of day, distance, estimated travel time, number of passengers, luggage, requested vehicle type, airport or cruise traffic, tolls, parking, wait time, extra stops, special requests, holidays, late-night or early-morning service, and vehicle availability.

Unless stated otherwise in writing, quoted prices apply only to the specific trip details provided at the time of quote. A quote may change if the trip details change, including changes to pickup time, pickup location, drop-off location, passenger count, luggage, stops, flight schedule, cruise schedule, wait time, vehicle type, or service requirements. We do not guarantee that a quote will remain available indefinitely unless we state an expiration time in writing.

5. Payment

Payment terms will be provided at the time of booking. We may require full payment, partial payment, or a deposit before confirming or completing a reservation. Payment may be processed through a third-party payment provider, such as Square or another payment processor. By paying through a third-party provider, you may also be subject to that provider's terms and policies.

A reservation may not be considered confirmed until required payment is received and written confirmation is sent. Additional charges may be billed before, during, or after service if they are not included in the original quote. These may include extra wait time, additional stops, route changes, tolls, parking, airport fees, cruise terminal fees, cleaning fees, damage fees, or other charges caused by changes to the confirmed trip.

6. Cancellations

Cancellation rules and any cancellation fees may be provided at the time of booking confirmation. Unless a different cancellation policy is stated in writing for your reservation, we may apply the following default cancellation policy:

  • Cancellations made more than 24 hours before the scheduled pickup time may be charged 50% of the trip amount.
  • Cancellations made 24 hours or less before the scheduled pickup time may be charged up to the full trip amount.
  • Cancellations for airport, cruise, holiday, special-event, long-distance, or high-demand trips may be subject to stricter cancellation terms if disclosed at booking.

Refunds, when approved, may take several business days to process depending on the payment provider. Payment-processing fees and non-recoverable costs may be deducted from any approved refund.

7. No-Shows

A no-show occurs when the assigned vehicle arrives at the confirmed pickup location at or near the confirmed pickup time and the passenger does not appear, cannot be contacted, refuses service, provides an incorrect pickup location, or fails to meet the driver within the applicable waiting period.

No-shows may be charged up to the full trip amount. If you are unable to locate the driver, you must contact us immediately by phone, SMS, WhatsApp, or the communication method used for the booking. Leaving the pickup area without contacting us may be treated as a no-show.

8. Waiting Time

Each reservation may include a limited waiting period, which may vary by trip type and will be communicated when applicable. Airport pickups may include a different waiting period depending on the airport, flight status, terminal conditions, baggage claim delays, immigration/customs delays, and pickup rules. Cruise terminal pickups may include a different waiting period depending on ship arrival, disembarkation, customs, traffic, and terminal rules.

Additional waiting time may result in extra charges and is subject to driver and vehicle availability. We are not required to wait indefinitely. If the passenger is not ready within the applicable waiting period and no reasonable arrangement is made, the trip may be treated as a no-show.

9. Flight, Cruise, and Schedule Changes

You are responsible for providing accurate flight, airline, cruise, terminal, and arrival information. We may monitor flight or cruise information when available, but we do not guarantee monitoring accuracy. Airline, airport, cruise, port, traffic, weather, or third-party data may be delayed, incomplete, or incorrect.

You must notify us directly of delays, cancellations, early arrivals, missed flights, changed flights, changed terminals, changed cruise schedules, or other schedule changes. We will make reasonable efforts to adjust when possible, but schedule changes are subject to vehicle and driver availability and may result in additional charges.

10. Passenger Conduct and Safety

Passengers must act safely, lawfully, and respectfully. We may refuse, suspend, or terminate service without refund if a passenger:

  • Threatens, harasses, abuses, or distracts the driver
  • Engages in illegal activity or creates an unsafe condition
  • Refuses to wear a seat belt where required
  • Attempts to exceed vehicle passenger capacity
  • Damages or soils the vehicle
  • Possesses unlawful weapons or controlled substances
  • Is excessively intoxicated or disorderly
  • Fails to follow reasonable safety instructions
  • Violates airport, cruise terminal, hotel, resort, or venue rules

The driver may end the trip at a safe location if passenger behavior creates a safety risk.

11. Seat Belts, Child Seats, and Minors

Passengers are responsible for complying with applicable seat belt and child-restraint laws. Child seats may be available upon request, subject to availability and confirmation. A child seat is not guaranteed unless confirmed in writing. Parents or guardians are responsible for requesting the correct type of child seat and for ensuring that children are properly secured.

We may refuse service if the number of passengers exceeds vehicle capacity or if children cannot be transported safely and legally. Minors must be accompanied by a responsible adult unless we have expressly agreed in writing to a different arrangement.

12. Luggage and Personal Property

You are responsible for your own luggage and personal belongings. You must provide accurate luggage details before booking. We may refuse or modify service if the luggage exceeds the vehicle's safe or practical capacity.

We are not responsible for items left in the vehicle, lost items, damaged luggage, theft, or loss of personal property, except to the extent caused by our gross negligence or willful misconduct. If an item is found, we will make reasonable efforts to arrange return. Delivery, shipping, parking, tolls, or driver time related to returning lost items may result in additional charges.

13. Vehicle Assignment

Vehicle type may be based on passenger count, luggage, availability, route, and service needs. We may substitute a comparable or larger vehicle when necessary due to availability, maintenance, safety, scheduling, or operational reasons. Specific vehicle make, model, color, or driver is not guaranteed unless expressly confirmed in writing.

14. Extra Stops and Route Changes

Extra stops, route changes, drive-through stops, store stops, hotel stops, or destination changes are not included unless confirmed in writing. Requested changes during a trip are subject to driver approval, vehicle availability, schedule availability, legal restrictions, and additional charges. We may refuse route changes that create safety, legal, timing, or operational issues.

15. Cleaning and Damage

You are responsible for damage, excessive mess, stains, spills, odors, vomiting, food or drink mess, smoke odor, pet mess, or other conditions caused by you or your passengers. Cleaning, repair, downtime, or damage charges may be billed after the trip. Smoking, vaping, and illegal drug use are not allowed in the vehicle. Food and drinks may be restricted at the driver's discretion.

16. Pets and Service Animals

Pets are allowed only with prior written approval. If a pet is approved, the passenger is responsible for controlling the pet and for any cleaning or damage caused by the pet. Service animals will be accommodated as required by applicable law.

17. Accessibility and Special Requests

We will make reasonable efforts to accommodate special requests when provided in advance. We do not guarantee that every vehicle can accommodate every mobility device, accessibility need, medical need, passenger requirement, or luggage requirement. You must disclose any special loading, mobility, medical, accessibility, or space requirement before booking so we can determine whether the requested service can be safely provided.

We do not provide medical transportation, emergency transportation, or non-emergency medical transportation unless expressly agreed in writing and legally permitted.

18. Delays and Events Outside Our Control

We are not liable for delays, service interruptions, route changes, or inability to complete service caused by events outside our reasonable control, including traffic, road closures, accidents, severe weather, flooding, airport or cruise terminal congestion, theme park or event traffic, police activity, mechanical issues, government action, natural disasters, public emergencies, or acts or omissions of third parties. We will make reasonable efforts to communicate and adjust when possible.

19. Missed Flights, Cruises, Events, or Connections

We are not responsible for missed flights, missed cruise departures, missed events, missed reservations, missed connections, lost business, lost wages, emotional distress, or other indirect losses, except to the extent such limitation is prohibited by law. You are responsible for choosing a pickup time that allows enough travel time for traffic, security, baggage, check-in, boarding, cruise processing, venue entry, and other delays.

20. Website Use

You may use our website only for lawful purposes and legitimate quote or service requests. You may not misuse the website, submit false information, interfere with website operation, attempt unauthorized access, scrape data, send spam, or use the website for fraudulent or unlawful purposes. We may suspend or block website access if we suspect misuse, fraud, security risk, or violation of these Terms.

21. Intellectual Property

The website, text, graphics, logos, branding, layout, forms, and other content are owned by or licensed to Marlo Private Transport Florida, unless otherwise stated. You may not copy, reproduce, distribute, modify, or use our content or branding for commercial purposes without written permission.

22. Privacy

Our collection and use of personal information is described in our Privacy Policy. By using our website or services, you also agree to the practices described there.

23. Compliance With Law

We intend to operate in compliance with applicable federal, state, and local laws, rules, insurance requirements, airport rules, port rules, and transportation requirements. Nothing in these Terms is intended to waive, limit, or replace any legal requirement that cannot be waived or limited by contract. If any part of these Terms conflicts with applicable law, the applicable law controls.

24. Disclaimer of Warranties

Our website and services are provided "as is" and "as available," except as expressly stated in writing. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, availability, uninterrupted service, accuracy of website content, and non-infringement. Some limitations may not apply where prohibited by law.

25. Limitation of Liability

To the fullest extent permitted by Florida law, Marlo Private Transport Florida and its owners, drivers, contractors, service providers, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the website, quote requests, bookings, or transportation services. This includes damages related to missed flights, missed cruises, missed events, lost profits, lost wages, lost opportunities, emotional distress, inconvenience, delay, or third-party costs.

To the fullest extent permitted by law, our total liability for any claim related to a specific trip will not exceed the amount actually paid by you for that specific trip. Nothing in these Terms limits liability that cannot legally be limited, including liability for gross negligence, willful misconduct, or bodily injury where limitation is prohibited by law.

26. Indemnification

You agree to indemnify and hold harmless Marlo Private Transport Florida and its owners, drivers, contractors, service providers, and representatives from claims, damages, losses, liabilities, costs, and expenses, including reasonable attorney's fees, arising from your violation of these Terms, your misuse of the website or services, false, incomplete, or inaccurate information you provide, unsafe or unlawful passenger conduct, damage caused by you, your passengers, your luggage, or your pets, or your violation of applicable law or third-party rights.

27. Disputes and Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute arising out of or relating to these Terms, the website, a quote request, a booking, or transportation services will be handled in the state or federal courts located in Florida, unless applicable law requires a different venue. You consent to personal jurisdiction and venue in Florida courts to the extent permitted by law.

28. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page shows when these Terms were most recently revised. Changes become effective when posted on our website unless otherwise stated. Continued use of our website or services after changes are posted means you accept the revised Terms.
